Rules for the handling of personal data

1. Information about BANANA.IT s.r.o.

1.1. These rules on the handling of personal data have been adopted by the company BANANA.IT s.r.o., Company ID: 173 80 910, registered office: U Mlýnského 696/6, Karlín, 186 00 Praha 8, registered in the Commercial Register kept at the Municipal Court in Prague, file no.: C 370348 (hereinafter referred to as'BANANA.IT“).

1.2. These rules govern the principles of processing personal data of customers of BANANA.IT (hereinafter referred to as”customers“).

1.3. BANANA.IT acts as a controller and processor in the processing of personal data of customers.

2. What data do we process?

2.1. Data provided by customers — BANANA.IT primarily processes personal data that you provide to us when purchasing sports or other equipment or when booking a sports venue operated by BANANA.IT or its intermediary provider. This data includes, in particular, your first and last name, e-mail address and telephone number, or other data that you voluntarily provide.

3. For what purposes do we process the data?

3.1. We process personal data in order to (a) fulfill the obligation — to fulfill the rights and obligations of BANANA.IT as a provider or intermediary of purchase contracts or sports services or sports venues and (b) to fulfill the legal obligations imposed by BANANA.IT as an administrator by generally binding legislation.

3.2. Personal data are/are not transferred to a third country.

3.3. The personal data of BANANA.IT business partners are collected and stored for the purpose of (a) fulfilling contractual obligations arising from the contractual relationship (including limitation periods and warranty periods) and (b) for the period of registration required by generally binding legal regulations.

4th. Withdrawal of consent

4.1. BANANA.IT uses cookies to ensure the functionality of the website and/or application (collectively, the “Website”) and to adjust its behaviour. Furthermore, cookies are used for statistical monitoring of how the website is used and for marketing purposes. If you want to disable the storage of cookies on your device, you can change the settings by clicking on the link”Cookie settings“in the footer of the BANANA.IT website or in the application or change the settings directly in your browser. In the event that you disable BANANA.IT from storing cookies, some parts of the website may not work properly.

5. Who has access to the data?

5.1. Personal data is processed by BANANA.IT. In addition to BANANA.IT, other beneficiaries are public authorities (e.g. financial administration, CSSA, health insurance companies), providers of ordered services and other beneficiaries resulting from the proper performance of legal and contractual obligations (e.g. auditors, tax advisers).

6. How long do we process the data?

6.1. BANANA.IT processes personal data for the period necessary for the use of BANANA.IT sports facilities. By law BANANA.IT subsequently retains some of the data contained in the accounting documents.

6.2. The data collected for marketing purposes through cookies is processed by BANANA.IT for the duration of the consent to the use of cookies, i.e. as long as you allow the storage of cookies within the cookies settings on the BANANA.IT website or in your browser. Processing may continue after withdrawal of consent, and not longer than the expiration time of the respective type of cookie.

6.3. Further processing of personal data beyond the stated deadlines is carried out by BANANA.IT only if this is necessary for the fulfillment of obligations arising from legal regulations or contractual arrangements to which BANANA.IT is bound.

7. What are your rights?

7.1. In connection with the processing of personal data, you can contact BANANA.IT and request:

— Information about the personal data processed by BANANA.IT, about the purpose and nature of the processing of personal data, including information about possible recipients of personal data outside BANANA.IT.

— Access the data you have provided to BANANA.IT. In case of exercising this right, BANANA.IT will confirm to you whether and what specific personal data are processed and, if necessary, these data will be made available to you together with information about their processing.

— Correction of personal data if they are inaccurate or incomplete in any way. Only in the case of up-to-date data can BANANA.IT correctly ensure the full use of your membership rights and obligations.

— Explanation and elimination of the defective situation (e.g. blocking, correction, replenishment or destruction of personal data) if you believe that BANANA.IT processes personal data in violation of the protection of your personal and private life or in violation of the law.

— Deletion of personal data (the so-called right to be forgotten) or their limited processing, if they are no longer necessary for the stated purposes, or if BANANA.IT no longer has a legal reason to process personal data, including if you do not agree to their further processing. Within the framework of compliance with the above conditions, BANANA.IT will completely or partially dispose of your data. However, please note that failure to provide personal data may result in restriction of the rights arising from the use of sports facilities operated by BANANA.IT.

— Transfer of automatically processed personal data obtained on the basis of your consent from BANANA.IT to another entity, where BANANA.IT transmits your personal data in the commonly used format to you or to another controller according to your wishes.

7.2. In addition to the above permissions, you always have the opportunity to contact the Office for Personal Data Protection in case of violation of BANANA.IT obligations with a complaint, see hereunder.

8. Security

8.1. BANANA.IT takes care of the security of your data. The processing of personal data is carried out in full compliance with applicable legislation, including the General Data Protection Regulation (GDPR). BANANA.IT places great emphasis on the technical and organizational security of the processed data when processing personal data.

8.2. All personal data in electronic form shall be stored in databases and systems accessible only to persons who need immediate processing of personal data for the purposes specified in these Rules and only to the extent necessary. Access to this personal data is protected by a password and firewall or by mechanical means. The security of personal data is regularly tested by BANANA.IT and we continuously improve the protection.
